FAQ's

Employment legislation is complex, and an HR Consultant can get to know your business and help you to ensure compliance across all areas of HR, supporting you during difficult meetings or acting as a sounding board when you are thinking of making changes within your business. An Employee Relations specialist has experience dealing with third parties such as trade unions, conciliators or in some cases, solicitors.

It is quite common for HR functions to be busy dealing with their day to day tasks. At times they cannot create the capacity to deal with project work such as reviewing policy and procedures, revisiting organisation structures or entering into a consultation process with trade unions. Also, at times, your HR team may feel conflicted, during a complex grievance or disciplinary appeal that they have already had involvement with at a previous stage.

For workplace Mediation to be effective the process needs to be Voluntary, Independent and Confidential.

This is difficult to achieve when the person facilitating the Mediation process is employed by the Organisation. Often the disputing parties feel obliged to attend a mediation process that has been arranged by their Manager or HR department and therefore you will never know if their participation in the process is truly Voluntary. When the Mediator is external, it is difficult to question their independence in the process. Employees participating in the process can return to work afterwards without having to bump into the Mediator at work in future. Ultimately, an external Mediator can achieve greater results because they are external to your Organisation.
